DDA’s Bulldozer on Illegal Construction: Two-Way Action Following Court Clearance and Anti-Encroachment Drive on Government Land in Delhi

Delhi Development Authority (DDA) recently used bulldozers on an illegal bungalow in the Sainik Farm area despite pending court proceedings. Aadil Sherwani, the owner of the farmhouse, could not obtain a stay order to stop the demolition.

Delhi Voice News Agency (DVNA News) observes that when DDA carries out bulldozer action by following anti-encroachment government rules on DDA land, courts also do not grant stay orders easily in some cases.

DDA had already announced in the first week of December that demolition would be carried out in two phases in the Tilpath Valley of the Sainik Farm area. Aadil Sherwani’s farm was not demolished during the first phase due to court proceedings. However, the court did not grant a stay order despite him approaching the court, and DDA proceeded with bulldozer action on the farmhouses.

DDA launched the bulldozer drive in the Sainik Farm area with several earth movers, along with the deployment of police and paramilitary personnel.

दिल्ली विकास प्राधिकरण (DDA) ने हाल ही में दिल्ली के सैनीक फ़ार्म क्षेत्र में अवैध निर्माण के खिलाफ बुलडोज़र कार्रवाई की। यह कार्रवाई अदालत की प्रक्रिया के अनुरूप और सरकारी ज़मीन से अतिक्रमण हटाने के उद्देश्य से की गई।

सैनीक फ़ार्म क्षेत्र में स्थित एक अवैध बंगले पर, जिसके मालिक आदिल शेरवानी बताए जा रहे हैं, DDA ने अदालत में मामला लंबित होने के बावजूद कार्रवाई की। आदिल शेरवानी अदालत से स्थगन आदेश (स्टे ऑर्डर) प्राप्त करने में असफल रहे, जिसके चलते DDA ने अवैध निर्माण को ध्वस्त कर दिया।

दिल्ली वॉयस न्यूज़ एजेंसी (DVNA NEWS) के अनुसार, जब DDA अपनी भूमि पर सरकारी नियमों के तहत अतिक्रमण विरोधी अभियान चलाती है, तो कई मामलों में अदालतें आसानी से स्थगन आदेश नहीं देतीं। इसी कारण, अदालत में याचिका दायर होने के बावजूद कार्रवाई जारी रहती है।

DDA ने दिसंबर के पहले सप्ताह में ही घोषणा कर दी थी कि सैनीक फ़ार्म क्षेत्र के तिलपत वैली में ध्वस्तीकरण अभियान दो चरणों में चलाया जाएगा। पहले चरण में आदिल शेरवानी का फार्म हाउस अदालत में मामला लंबित होने के कारण नहीं गिराया गया था। हालांकि, बाद में अदालत द्वारा स्थगन आदेश न दिए जाने पर दूसरे चरण में उनके फार्म हाउस पर बुलडोज़र चला दिया गया।

सैनीक फ़ार्म क्षेत्र में की गई इस कार्रवाई के दौरान DDA के साथ कई अर्थ मूवर मशीनें मौजूद थीं, जबकि कानून-व्यवस्था बनाए रखने के लिए पुलिस और अर्धसैनिक बलों की तैनाती भी की गई थी।
